Terms of service

These terms are an agreement between Spark Foundry ("we") and the business that uses our service ("you").

1. The service

Spark Foundry provides an online platform that generates lifestyle images, close-ups, dimensioned images and short videos of lighting products from the data and images you provide, and lets you review, approve and download them in your client gallery. The service is offered to businesses only.

2. Your account

You are responsible for the people you invite to your account and for keeping sign-in details secure. Tell us promptly if you suspect unauthorised use.

3. Your content

You keep ownership of the product data and images you upload. You confirm you have the right to provide them and you give us permission to use them to provide the service, including sending them to the AI providers we use to generate and check images.

4. Generated images

Once you have downloaded and paid for an image, you may use it to market and sell your products. Generated images are produced by AI and may contain errors. You are responsible for reviewing each image before you approve, download or publish it.

5. Fees and payment

We charge only for full image downloads, at the per-image, per-resolution rates in your quote. Generation, review, approval, regenerations, edits, re-crops and fixes are not charged. Downloads are billed in batches on our twice-monthly invoicing cycle or by invoice. Payments are processed by Stripe. Our pricing page and refund and cancellation policy form part of these terms.

6. Acceptable use

Do not upload content you do not have the right to use, attempt to break or overload the service, or use it to make misleading images of products that are not yours.

7. Availability and changes

We work to keep the service available but do not guarantee uninterrupted service. We may change or improve features over time.

8. Disclaimers and limitation of liability

The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amounts you paid us in the three months before the claim arose.

9. Ending the agreement

You can stop using the service at any time. We may suspend or close an account that breaches these terms or is not paid. Downloads made before the account ends remain payable.

10. Governing law

These terms are governed by the laws of the State of Delaware, United States, and disputes will be handled by the courts located in Delaware.
